face=\"仿宋_GB2312\">根据《人民检察院刑事诉讼规则》《人民检察院办理刑事申诉案件规定》等规定，人民检察院管辖下列刑事申诉案件：<\/font><\/span>\n<p class=\"MsoNormal\" style=\"text-indent:32.0000pt;mso-char-indent-count:2.0000;mso-layout-grid-align:none;&#10;layout-grid-mode:char;line-height:28.0000pt;mso-line-height-rule:exactly;\"><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">1.不服人民检察院因犯罪嫌疑人没有犯罪事实，或者符合《中华人民共和国刑事诉讼法》第十六条规定情形而作出的不批准逮捕决定的申诉； <\/span><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" initial;\"><font face=\"仿宋_GB2312\">人民检察院受理刑事申诉案件符合下列条件，人民检察院应当受理，另有规定的除外：<\/font><\/span><span style=\"font-family: 仿宋_GB2312; font-size: 16pt; background-image: initial; background-position: face=\"仿宋_GB2312\">1. 属于《人民检察院办理刑事申诉案件规定》第二条规定的刑事申诉；<\/font><\/span><span style=\"font-family: 仿宋_GB2312; font-size: 16pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"p\" align=\"justify\" style=\"margin-top: 0pt; margin-bottom: 0pt; text-indent: 32pt; text-align: justify; line-height: 28pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><span style=\"font-family: 仿宋_GB2312; font-size: 16pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><font face=\"仿宋_GB2312\">2.属于人民检察院管辖范围；<\/font><\/span><span style=\"font-family: 仿宋_GB2312; font-size: 16pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"p\" align=\"justify\" style=\"margin-top: 0pt; margin-bottom: 0pt; text-indent: 32pt; text-align: justify; line-height: 28pt; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; face=\"仿宋_GB2312\">申诉人委托律师代理申诉，且符合上述条件的，应当受理。<\/font><\/span><span style=\"font-family: 仿宋_GB2312; font-size: 16pt; background-image: initial; background-position: initial; background-size: initial; face=\"仿宋_GB2312\">刑事申诉应提交的材料<\/font> <\/span><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:32.0000pt;mso-char-indent-count:2.0000;line-height:28.0000pt;&#10;mso-line-height-rule:exactly;\"><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">申诉人向人民检察院提出申诉时，应当递交申诉书、身份证明、相关法律文书及证据材料或者证据线索。<\/span><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:32.0000pt;mso-char-indent-count:2.0000;line-height:28.0000pt;&#10;mso-line-height-rule:exactly;\"><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">身份证明是指自然人的居民身份证、军官证、士兵证、护照等能够证明本人身份的有效证件；法人或者其他组织的营业执照副本和法定代表人或者主要负责人的身份证明等有效证件。申诉人系正在服刑的罪犯，有效证件由刑罚执行机关保存的，可以提供能够证明本人身份的有效证件的复印件。对身份证明，人民检察院经核对无误留存复印件。<\/span><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:32.0000pt;mso-char-indent-count:2.0000;line-height:28.0000pt;&#10;mso-line-height-rule:exactly;\"><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">相关法律文书是指人民检察院作出的决定书、刑事申诉审查、复查结论文书，或者人民法院作出的刑事判决书、裁定书等法律文书。<\/span><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\"><o:p><\/o:p><\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-indent:32.1500pt;mso-char-indent-count:2.0000;line-height:28.0000pt;&#10;mso-line-height-rule:exactly;\"><b><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';mso-ansi-font-weight:bold;font-size:16.0000pt;&#10;mso-font-kerning:1.0000pt;\">四、<\/span><\/b><span style=\"mso-spacerun:\'yes\';font-family:仿宋_GB2312;mso-hansi-font-family:Calibri;&#10;mso-bidi-font-family:\'Times New Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">申诉人递交的申诉书应当写明下列事项：<\/span><span Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">（一）申诉人的姓名、性别、出生日期、工作单位、住址、有效联系方式，法人或者其他组织的名称、<\/span><span Roman\';font-size:16.0000pt;mso-font-kerning:1.0000pt;\">（二）申诉请求和所依据的事实与理由；<\/span><span
